Maryland HOA Law โ€” Your Rights

Maryland law provides significant homeowner protections that override HOA covenants in certain areas.

2021

Low-Impact Landscaping Act (HB 322)

Your HOA cannot prohibit native plant gardens, rain gardens, pollinator gardens, or xeriscaping โ€” as long as you maintain them.

Right to Dry (ยง14-130)

Your HOA cannot prohibit clotheslines or drying lines on your property regardless of HOA covenants.

Before any fine, the HOA must: send written demand, give time to comply, send hearing notice (min 10 days), hold a hearing if requested โ€” then fine.

Your HOA cannot prohibit solar collectors or EV charging in your deeded parking space. Reasonable aesthetic standards may apply.

Frequently Asked Questions

Who is responsible for snow removal on sidewalks?
Each homeowner is responsible for clearing snow and ice from the sidewalk and grass strip adjacent to their lot โ€” even though these areas are in the Town's right-of-way. The HOA clears sidewalks in front of common areas with no adjacent home. The Town of Charlestown is responsible for the road surface.
Are commercial vehicles allowed in the community?
The Declaration restricts commercial vehicles in common areas and the road dedication area. The Board is working on a formal definition for consistent enforcement. Contact the Board with specific questions.
Can I plant a native plant garden or naturalize part of my yard?
Yes. Maryland's Low-Impact Landscaping Act (HB 322, Oct 2021) protects your right to maintain native plant gardens, rain gardens, pollinator gardens, and naturalized areas. You must maintain and regularly tend to the landscaping.
What happens if I receive a violation notice?
Under Maryland law (ยง11B-111.10, Oct 2024), before any fine you have the right to: written notice of the violation, reasonable time to correct it, written notice of your right to a hearing (min 10 days), and a hearing before the Board if requested.
Can I install an EV charger or solar panels?
Yes. Maryland law protects your right to install solar collectors and EV charging equipment in your deeded parking space. The HOA may apply reasonable aesthetic standards but cannot outright prohibit these.
Do I need HOA approval for home improvements?
Yes โ€” and the Town of Charlestown requires an HOA approval letter before issuing permits for work at Cool Springs properties. Submit your request to the Board with plans before beginning any exterior modifications.
How do I request documents or financial records?
Contact the Board directly. Under Maryland law you have the right to inspect the HOA's financial records and governing documents. There is no charge for reviewing financial statements.
